Website Terms and Conditions

Elder Resources Strategies (ERS)
Effective Date: October 12, 2026

Welcome to the Elder Resources Strategies (“ERS,” “we,” “our,” or “us”) website. These Terms and Conditions govern your access to and use of our website, educational materials, downloadable resources, and other information made available through our website.

By accessing or using this website, you agree to these Terms and Conditions. If you do not agree, please discontinue use of the website.

1. Purpose of Our Website

Elder Resources Strategies provides educational information, resources, and professional consulting services related to Medicaid planning, long-term care planning, financial preparedness, and navigating the Medicaid application process in Nebraska and Iowa.

Our website is intended to help individuals, families, caregivers, and their professional advisors better understand long-term care planning options and prepare for potential care needs.

Information on this website is provided for general informational and educational purposes only.

2. No Legal, Tax, or Investment Advice

The information provided on this website does not constitute legal advice, tax advice, accounting advice, investment advice, or other regulated professional advice.

Although ERS may provide information about Medicaid eligibility requirements, asset rules, financial documentation, estate planning considerations, and long-term care options, this information should not be considered a substitute for advice from a qualified attorney, tax professional, accountant, financial advisor, or other appropriately licensed professional.

Laws and regulations vary by state and individual circumstances. You should consult the appropriate professional before making legal, financial, tax, or estate planning decisions.

3. No Guarantee of Medicaid Eligibility or Approval

Medicaid eligibility and benefits are determined by the applicable government agency under the laws, regulations, and policies in effect at the time of the application.

ERS does not guarantee that any individual will qualify for Medicaid, receive approval by a particular date, obtain coverage for a particular service, or receive a specific level of benefits.

Eligibility may depend on numerous factors, including income, assets, marital status, medical needs, level of care, residency, financial transactions, documentation, and applicable state and federal requirements.

Any examples, projections, or discussions of potential outcomes are illustrative only and should not be interpreted as a promise or guarantee.

4. Scope of Services and Medicaid Application Assistance

ERS provides Medicaid planning, application preparation and submission assistance, document coordination, and related support for individuals and families navigating long-term care Medicaid programs in Nebraska and Iowa.

Depending on the client’s service agreement, ERS services may include:

  • Reviewing client-provided financial and supporting documentation for application preparation.
  • Assisting with the completion and submission of Medicaid applications and related forms.
  • Coordinating the collection and organization of requested records.
  • Communicating and corresponding with the Nebraska Department of Health and Human Services (DHHS), Iowa Health and Human Services (HHS), and other relevant agencies regarding a client’s application, as authorized.
  • Relaying agency requests, notices, and communications to clients.
  • Assisting clients with responding to requests for additional documentation.
  • Providing updates regarding application status and outstanding information.
  • Helping clients understand application procedures and next steps.

The specific services provided will depend on the client’s written service agreement and any required authorizations.

ERS is not a government agency and does not control Medicaid eligibility determinations, processing times, benefit amounts, or approval decisions. The relevant government agency retains sole authority to determine eligibility and approve, deny, or otherwise act on an application.

Unless expressly authorized and legally permitted, ERS does not provide legal representation, appear on behalf of clients in legal proceedings, or provide legal advice. Clients may need to consult an attorney regarding appeals, contested eligibility determinations, asset transfers, trusts, estate planning, or other legal matters.

Authorization to Communicate and Submit Applications

Clients understand that ERS may need permission to submit applications, communicate with government agencies, receive case-related information, and provide documents on their behalf.

Clients agree to execute any required agency forms, releases, authorized representative designations, or other documentation necessary for ERS to perform the agreed-upon services.

ERS will act within the scope of the client’s authorization and applicable law. Clients remain responsible for reviewing and providing accurate information and for signing documents when required.

An engagement with ERS does not automatically grant ERS legal authority to act as a client’s authorized representative. Any required authorization must be completed in accordance with the applicable agency’s procedures.

Client Cooperation and Agency Deadlines

Clients are responsible for providing complete and accurate information and requested documentation in a timely manner. Clients must promptly notify ERS of changes in income, assets, marital status, residence, medical condition, care setting, or other circumstances that may affect eligibility.

ERS will make reasonable efforts to communicate known agency deadlines and coordinate responses within the scope of its services. However, ERS cannot guarantee that an agency will process an application or issue a determination by a particular date.

Clients should promptly review agency notices and communications, cooperate with information requests, and immediately notify ERS of any notice, deadline, denial, hearing opportunity, or appeal right they receive directly.

Unless expressly agreed in writing and legally permitted, ERS does not guarantee that it will identify or manage every deadline, pursue an appeal, or provide legal representation in a contested matter.

Government Decisions and Application Outcomes

Submitting an application does not guarantee eligibility or approval. Government agencies may request additional information, conduct further reviews, impose applicable eligibility rules or penalties, deny an application, or determine a different effective date of coverage.

ERS does not control agency decisions or processing times. Any estimated timeline or discussion of potential eligibility is an estimate only and is not a guarantee of a particular outcome.

5. Client Responsibilities

Clients are responsible for providing complete, accurate, and truthful information relevant to their planning needs.

You agree to:

  • Provide accurate financial, medical, legal, and personal information as reasonably requested.
  • Disclose relevant financial transactions, asset transfers, income sources, and changes in circumstances.
  • Review documents and information before they are submitted to a government agency.
  • Promptly respond to requests for additional information or documentation.
  • Make informed decisions regarding your finances, care arrangements, and applications.
  • Seek independent legal, tax, financial, or other professional advice when appropriate.
  • Notify ERS of material changes that may affect your planning or application.

ERS relies on information supplied by clients and third parties. Incomplete, inaccurate, outdated, or delayed information may affect the quality, timing, or outcome of planning services.

Clients remain responsible for the truthfulness and completeness of information submitted in their names.

6. Medicaid Rules and Changing Requirements

Medicaid programs, financial eligibility standards, application procedures, documentation requirements, and long-term care rules may change over time.

Although ERS makes reasonable efforts to provide useful and current information, we do not guarantee that all website content is complete, current, or applicable to every situation.

Information on this website may not reflect the most recent changes in federal law, Nebraska law, Iowa law, administrative guidance, or agency procedures.

For official program information, consult the appropriate state agency:

You are responsible for confirming the requirements applicable to your circumstances before acting on website information.

7. No Guarantee of Financial Outcomes or Asset Protection

ERS may discuss planning strategies intended to help families understand potential long-term care costs, prepare for Medicaid eligibility requirements, and evaluate available planning options.

No information or service provided through this website guarantees asset preservation, avoidance of a Medicaid penalty, protection from estate recovery, reduction of care expenses, or any particular financial result.

The availability and suitability of a planning strategy depend on individual facts, applicable laws, timing, and other circumstances.

You should obtain qualified legal and financial advice before transferring assets, changing ownership arrangements, creating trusts, making gifts, or taking other significant financial actions.

8. Fees, Payments, and Cancellations

Any fees, payment schedules, refund policies, cancellation terms, and service-specific conditions will be communicated through the applicable service description, invoice, or written client agreement.

Unless otherwise agreed in writing, use of this website does not establish a professional engagement or obligate ERS to provide consulting services.

A consultation request, email, website inquiry, or appointment booking does not create a client relationship by itself.

Please review any applicable client service agreement carefully before purchasing or beginning services.

9. Website Content and Intellectual Property

Unless otherwise indicated, the content on this website is owned by or used with permission by Elder Resources Strategies.

Website content may include text, articles, educational guides, downloadable documents, graphics, logos, branding, and other materials.

You may access and use this content for your personal, noncommercial educational purposes.

You may not reproduce, republish, distribute, modify, sell, or commercially exploit website content without prior written permission, except where permitted by law.

Downloading a guide or other resource does not transfer ownership of the underlying content or grant permission to use it commercially.

10. Downloadable Guides and Educational Resources

ERS may offer downloadable guides, checklists, worksheets, articles, or other educational resources, including materials intended to help individuals become more prepared for Medicaid planning.

These resources are general educational tools. They are not a determination of eligibility, a substitute for individualized planning, or a guarantee that an application will be approved.

The documents and information needed for a particular Medicaid application will depend on the individual’s circumstances and the requirements of the relevant program.

You are responsible for verifying that any resource is appropriate for your situation and current at the time you use it.

11. Privacy and Confidential Information

ERS respects the privacy of website visitors and prospective clients.

Information submitted through our website may be used to respond to inquiries, provide requested information, communicate about services, and operate our business in accordance with our Privacy Policy and applicable law.

Please do not submit Social Security numbers, bank account information, passwords, medical records, or other highly sensitive personal information through an ordinary website contact form or unsecured email.

Submitting information through this website does not automatically establish a confidential professional relationship or guarantee that communications are protected by attorney-client privilege.

Please review our Privacy Policy for additional information about how personal information is collected, used, disclosed, and protected.

12. Third-Party Websites and Resources

This website may contain links to government agencies, professional organizations, service providers, or other third-party websites.

These links are provided for convenience and informational purposes. ERS does not control or guarantee the accuracy, availability, security, or content of third-party websites.

A link does not imply endorsement, affiliation, or a guarantee of the services provided by the third party.

You access third-party websites at your own discretion and subject to their respective terms and privacy policies.

13. Website Availability and Security

ERS makes reasonable efforts to maintain website availability and provide useful information. However, we do not guarantee uninterrupted access, error-free operation, or that the website will be free of viruses or other harmful components.

We reserve the right to update, modify, suspend, or discontinue any portion of the website without prior notice.

You are responsible for using appropriate security measures when accessing the internet, downloading materials, or communicating personal information online.

14. Disclaimer of Warranties

To the fullest extent permitted by applicable law, this website and its content are provided on an “as is” and “as available” basis.

ERS disclaims warranties, express or implied, to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.

We do not warrant that website information will meet every user’s needs, that errors will be corrected, or that access to the website will always be available.

Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Elder Resources Strategies and its owners, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to the use of this website or reliance on its general educational content.

This includes, where legally permitted, losses associated with decisions made based on website information, changes in Medicaid rules, third-party website content, or temporary website interruptions.

This section does not exclude or limit liability where such exclusion or limitation is prohibited by law, including liability that cannot legally be waived.

Any additional limitations applicable to professional consulting services should be addressed in the separate client service agreement.

16. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims or losses arising from your unlawful use of the website, your violation of these Terms and Conditions, or your infringement of another person’s rights.

Nothing in this section requires you to indemnify ERS for its own conduct to the extent such indemnification is prohibited by law.

17. Governing Law and Disputes

These Terms and Conditions will be interpreted under the laws applicable to the relevant dispute, subject to applicable conflict-of-law rules and any mandatory legal requirements.

Because ERS provides services in Nebraska and Iowa, the appropriate law and venue may depend on the circumstances, the location of the parties, and any applicable client service agreement.

Nothing in these Terms limits a consumer’s rights or remedies that cannot legally be waived.

18. Changes to These Terms

ERS may update these Terms and Conditions periodically to reflect changes in our services, website practices, or applicable requirements.

Updated terms will be posted on this page with a revised effective date. Your continued use of the website after updated terms are posted constitutes acceptance of the revised terms to the extent permitted by law.

We encourage visitors to review this page periodically.
